The Moroccan Federation of Insurance and reinsurance companies (FMSAR), supported by the Directorate of Insurance and Social Welfare (DAPS), has appointed the industry’s first-ever mediator to handle disputes between insurers and policyholders. The mediation system took effect from 1 January.
The aim is to streamline the resolution of a number of issues, and in particular to avoid court action. Mediation will also enable information to be collected on the most frequent types of disputes, and thus serve as a basis for insurance companies to adjust contract terms, according to local media reports.
For the moment, disputes involving amounts between MAD5,000 (US$504) and MAD50,000 will be handled by the mediator. Cases are to be referred to the mediator after all internal procedures for the settlement of claims by insurance companies have been exhausted.
