Morocco: Regulator cautions motor insurers over rejecting claims

The Insurance and Social Security Supervisory Authority (ACAPS) has issued a warning to motor insurance companies over practices that are deemed to infringe on policyholders’ rights.
 
Two recent circulars highlight the issue of partial compensation and the rejection of coverage related to drivers’ licences.
 
In the first, the Authority addresses the improper application of deductibles in motor claims. It warns against insurers applying the full deductible even when the insured is not fully responsible for the loss under supplementary covers such as third-party liability or collision damage. 
 
ACAPS emphasises that while insurers have the right of recourse against the at-fault third party, they must actively safeguard the insured’s interests and proportionally share any recovered amounts. Where full recovery is not obtained, insurers are required to compensate policyholders for the unrecovered portion in line with a prescribed formula.
 
In the second circular, ACAPS clarifies the application of driver’s licence exclusions. It states that insurers may only invoke this exclusion if the driver did not hold a valid licence or had been legally disqualified at the time of the accident. The Authority criticised cases where claims were denied solely because the physical licence had expired or renewal procedures were incomplete, stressing that an expired document does not automatically invalidate the right to drive.
 
Together, the circulars reaffirm ACAPS’ position that insurers must apply exclusions and deductibles fairly and in strict compliance with legal and regulatory provisions. M
