There are differences between common law and civil law systems as to the nature of the duty and the time of application of the concept of good faith. Messrs Samuel Wakerley and Thomas Neighbour of HFW Dubai highlight the key points to bear in mind in relation to good faith in the UAE and how this can impact marine claims.
